Flytippers fined over Liversedge beauty spot

The mountain of rubbish which was flytipped included wood, rubber, card and plastic and was found on Primrose Lane at the side of the Princess Mary playing fields.

Joga Singh Bahgota, of Broad Lane, Bramley, Leeds, and Michael Allwood of Ring Road, Seacroft, Leeds, appeared at Kirklees Magistrates Court on Wednesday January 8 charged with failing to comply with the Environmental Protection Act.

The court heard that Bahgota had allowed Allwood to carry out work on his business without making sure the waste collected was disposed of correctly.

He pleaded guilty and was fined £600 plus a £60 victim surcharge and £652 costs to include £200 towards the cost of clearance.

Allwood was employed by Bahgota to carry out the renovation work on his shop and allowed a third party to remove the waste without obtaining waste transfer documents.

He pleaded guilty and was fined £1,000 plus a £100 victim surcharge. He was also ordered to pay £950 costs to include £200 towards the cost of clearance.

After the case, Kirklees Cabinet member Coun Cathy Scott, said: “Perpetrators face a fine up to £50,000 and or a six month custodial sentence via the courts.

“They can be prosecuted by the council if local people report incidents in progress. Please call 01484 414700 and give all the details you can including time, place, make and model of vehicle, a description of those involved and information on what was being dumped. Please do not remove any evidence as the investigating officer will be looking at the dumped material and will recover everything they can.”
