ASBO for noisy neighbour

A noisy neighbour has been handed an anti-social behaviour order after being found guilty of noise pollution.

Daniel Smith, of Park Parade, Westtown, was prosecuted after breaching an abatement notice on three occasions with loud voices and amplified sound on September 20 and 28, and again on November 1 last year.

A warrant for the seizure of the audio equipment was obtained and two stereo systems, CDs and DVDs, speakers and an amplifier were confiscated.

The offence was proven in his absence at Kirklees Magistrates Court in December but the case returned for sentencing on February 12, when he was fined £110 with £140 costs and the sound equipment was forfeited.

He was also given a post-conviction ASBO for two years.

Coun Peter McBride, Kirklees joint cabinet member for place, said: “Night time noise can lead to upset and disturbance for your neighbours. The night time noise team try to resolve noisy neighbour complaints informally but will use the powers they have to seize music making equipment and prosecute offenders when necessary.”
